Minimum Advertised Price (MAP) Policy

Be Home, Inc. ("Be Home") has adopted this minimum advertised price (MAP) policy to protect and support the BE HOME brand value and development. This MAP Policy has been unilaterally adopted by Be Home and will be uniformly enforced.

This MAP Policy covers all vendors, resellers, and distributors (each, a "Seller") in the U.S. of products purchased through https://wholesale.behome.com (the "Be Home Products"). Each Seller is free to establish its own prices for Be Home Products; however, Be Home will, without assuming any liability, unilaterally impose sanctions as described in this MAP Policy on any Seller who advertises prices for Be Home Products below those specified herein.

This MAP Policy is non-negotiable, and Be Home will not discuss this policy with any Seller nor modify its terms for any Seller. Be Home does not seek evidence of compliance from Seller with this MAP Policy.

In no event is this MAP Policy intended to constitute an agreement between Be Home and any Seller. This is a unilateral policy implemented by Be Home.

This MAP Policy applies only to minimum advertised prices and does not apply to the price at which the products are actually sold, or to advertised prices higher than the minimum advertised prices established by Be Home from time to time.

The current minimum advertised price ("MAP") for Be Home Products is set forth on the current price list https://wholesale.behome.com/pricelist. It is also showing on https://wholesale.behome.com on every individual product page. The Be Home Products list and MAP may be changed at any time in Be Home’s sole discretion. Each Seller is responsible for its compliance with the current Be Home Products list and MAP.

Any advertisement with a price for Be Home Products below the MAP will be a violation of this MAP Policy. "Advertisement" means all media, including, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, mail order catalogs, Internet or similar electronic media, television, radio, social media, apps, and public signage.

Website features such as "click for price", automated "bounce‐back" pricing emails, pre‐formatted email responses, forms, and automatic price display for any items prior to being placed in a customer’s shopping cart, and other similar features, are considered to be communications initiated by the Seller (rather than by the customer) and thereby constitute "advertisement" under this MAP Policy.

It shall not be a violation of this MAP Policy to advertise that a customer may "call for price" or "email for price", or to use similar language, specifically with respect to Be Home Products, so long as no price is listed.

Be Home may unilaterally impose sanctions on any Seller that violates this MAP Policy. Such sanctions may include withholding Be Home Products from sale by such Seller. Be Home will determine violations of this MAP Policy in its sole discretion, and Be Home will not accept any correspondence from any Seller who has violated this MAP Policy regarding its compliance or non-compliance with this MAP Policy.

Be Home may modify, suspend, or discontinue this MAP Policy at any time in its sole discretion, including during promotional periods or other times designated by it.
